DWAI (Driving While Ability Impaired) is a charged based on an allegation that the driver was impaired to the slightest degree from alcohol and/or drugs. A jury is permitted to infer such impairment if a driver had a BAC of 0.05% or higher.

DWAI carries lighter penalties and less points, but it still results in a permanent conviction on the driver’s record.

Not automatically, but you must act quickly. You have only seven (7) days from your arrest (or 10 days from the postmark of the DMV letter for blood tests) to request a DMV hearing.
